Terms of Service
Last updated: April 25, 2026
By using Preserve Forever, you agree to these Terms of Service. If you do not agree, do not use the service.
You may use Preserve Forever to store personal photos and media. You may NOT upload, store, or share: child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), content that infringes on third-party intellectual property, malware, or any content illegal in your jurisdiction. Violations result in immediate account termination and reporting to relevant authorities.
We reserve the right to terminate any account that violates these Terms, with or without notice. Accounts with confirmed CSAM/NCII will be terminated immediately and reported to NCMEC and relevant law enforcement.
Plans are billed monthly via Stripe. Cancel anytime — your access continues until the end of the billing period. We do not offer refunds for partial months. We reserve the right to change pricing with 30 days notice. If your storage usage exceeds the cap of a lower plan, you will be asked to free up space (delete or restore from Vault) before downgrading; we will not silently delete your content. The Basic (free) plan does not include Memory Vault — you may need to remove vaulted content before downgrading to Basic.
Photos are encrypted in transit using TLS for all uploads, downloads, and API traffic. Photos at rest in cold storage (Memory Vault) are additionally encrypted at the application layer with AES-256-GCM using a per-user vault key. The vault keys are wrapped with a master key under our control so we can serve restore requests and run the legally-required CSAM scanning. This is close to, but not the same as, end-to-end encryption — a true end-to-end model would require keys held only by you, which would prevent server-side restore and the moderation we are required by law to perform. See our Privacy Policy for full detail.
We take your privacy seriously. Please review our Privacy Policy for details on data collection, content moderation, encryption, retention, and your rights under GDPR and similar regulations.
We aim for 99.9% uptime but do not guarantee it. We are not liable for losses resulting from service outages. Memory Vault retrieval times (typically 3–5 hours for Glacier Deep Archive thaw) are estimates only and may vary based on AWS service conditions.
Preserve Forever is provided "as is." We are not liable for any indirect, incidental, or consequential damages. Our maximum liability is limited to the amount you paid in the 3 months preceding the claim.
We may update these Terms from time to time. Material changes will be communicated via email and a notice on the dashboard. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
